This sets out the terms and conditions under which LiveTarotText (USA) Ltd (“LiveTarotText”, “Company”) provides Services to mobile phone users from time to time. This agreement constitutes the entire and only agreement between the parties relating to the subject matter of this agreement and supersedes and extinguishes any prior drafts, agreements, undertakings, representations and warranties and arrangements of any nature whatsoever in connection with the agreement.

BEFORE YOU USE OUR SERVICES, YOU MUST READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY. You should be aware that the terms and conditions and the charges for Services may change from time to time. Changes may be due to new regulatory requirements or due to changes made by the mobile phone network operators. These situations are beyond our control. We will always endeavor to provide prior notice of changes but sometimes we are bound to introduce changes with immediate effect in which case we will not be able to provide prior notice.

BY USING OUR SERVICES, YOU AGREE TO THESE TERMS AND CONDITIONS; IF YOU DO NOT AGREE; DO NOT USE THE SERVICES.

1. Description of Services

LiveTarotText provides downloadable/deliverable mobile entertainment content (Content or Services), such as Chat and Tarot services, ring tones, wallpapers, games and other information data through its on line (World Wide Web) and SMS (Short Message Services) Services to certain compatible mobile devices.
In these Terms of Sale:
“Content or Services” means logos, ring tones or any other content (text, graphical or application) that is deliverable to a mobile device / handset / phone.
“We”, “Us” or “Our” means LiveTarotText USA Ltd.
“You” or “Your” means the customer.
“Promotions”, “advertising material”, “promotional material”, “advertising” or “adverts” mean one and the same.

2. Types of Services you should expect

Services are primarily designed for adults and unless information is provided to the contrary all users of our Services must be at least 18 years of age.
The following is a list of the types of Services that we may run from:
- SMS Chat
- SMS Tarot
The above list is given by way of example and is not necessarily an exhaustive list, nor is it any form of commitment to provide the Services listed.
Certain Services may have additional terms and conditions, you should review those where applicable. They form part of these terms. To the extent there is any contradiction with the terms and conditions outlined herein these Terms shall apply.

3. When you respond to promotions

Responding to promotions means texting the Services as the result of anything that directly or indirectly encourages you to use the Services.
By responding to promotions you are agreeing to immediate provision of the advertised Services and that you are happy to receive the Service to the mobile phone that was used to initiate the Services.
You have the right to cancel the Services. You will not be entitled to any refund of that fee.
To exit or end any of the Services, send or SMS the words STOP, END, QUIT, CANCEL, STOP ALL, STOPALL or UNSUBSCRIBE to the advertised short code. You will be sent a confirmation message informing you that the service has ended.

4. Charges

You must follow instructions carefully as you will be billed / charged for errors including but not limited to incorrect spelling of product codes or keywords and sending messages of calling wrong short codes or numbers.
You agree to indemnify LiveTarotText against all errors caused by you. You will not be refunded or entitled to a refund where this is the case.
Charges are as follows:

The cost of sending an SMS to a short code is charged at your standard network rate. Please check with your network provider as to the costs of these based on your service plan.

The cost of receiving an SMS from 85555, 69988, 82888, 81777 or 84455 is £1.50 per SMS.

Monthly Usage caps apply to all services on all Mobile Networks. Check with your respective Mobile Network to ascertain the maximum spend limits on Premium SMS services.

Access to the Services may be restricted by carrier / service plan. If you try and access the Services and receive nothing back, in the first instance, please check that you’re Mobile Network allows you access to these Services.

In certain circumstances the agreements that we have entered into with the mobile phone network operators, we are obliged to notify you when you have reached certain charge / spending levels and in other specified circumstances to terminate the Services.
Charges will vary according to the Services and / or promotion that you respond to. Always check pricing on adverts as they appear.
A promotion that initiates a subscription service, will inform you of the charges involved.
Service operation and promotional messages sent to you are charged at your network standard rate. You should check with your respective Mobile Network as to the individual costs per Mobile Network.
From time to time some Services will charge you using a method known as Premium SMS (Reverse Billing). This may be initiated when you respond to a promotion using a short code. A short code may involve you sending a key word specified in the promotion to the short code number in the promotion. The charge for sending an SMS to the short code will be at the usual rates set by your mobile network operator. The Services will reply to the initiation with a Reverse Bill message, i.e. we will bill you for sending out a reply.
You may incur data charges (WAP or GPRS charges) when downloading certain Services to your mobile phone. Standard GPRS connection and download charges will apply in those circumstances. You should check with your respective network provider as to what these costs are. Please not that if you are using the Services abroad they may not work and GPRS / WAP data charges may be much higher.

A process called “Double opt – in“ is operated by most Mobile Networks for Premium SMS services. On this basis all customers will be clearly informed of the access costs of the services.

5. Acceptable Use

This Services gives you access to a range of live chat Services by telephone which includes mobile phones if your mobile network operator will allow it.
Our Services are intended primarily to appeal to a wide range of audiences but most are not suitable for use by children under the age of 16 years of age, unless otherwise stipulated. Live services are conducted with professionals contracted for such use.The views, opinions and conversations however so expressed and information provided, from such contracted professionals should not be taken as factual, accurate or in any way representative of the views of LiveTarotText, its employees or any associates. Parents and guardians will be held responsible for the actions of any children that use our Services and should remember the importance of supervising children’s use of telephone and mobile phone services.
If you do not follow the guidelines set out in various paragraphs of this agreement, you agree to indemnify us against all costs, demands, actions, costs, expenses (including but not limited to reasonable legal costs and disbursements), losses and damages arising from or incurred as a result of your actions.

6. Registration

When you register or respond to a promotion for Services you agree to and confirm that you are using true, accurate and current information about yourself and that includes your correct name, if requested to age verify that you have done so, and any further details requested.
When responding to promotions or calling the Services you must ensure that:
- You are fully entitled and authorise to use that mobile phone,
- The mobile phone account has available funds sufficient to cover the charges deducted from it.
Under certain regulations we are obliged to collect certain information from you from time to time in connection with, and prior to your participation in, certain Services e.g. before taking part in Chat services we may ask for your name, date of birth and confirmation that you have permission of the bill payer to use the services.

7. Privacy

Our privacy policy is included within the scope of these terms and conditions and you agree to our handling of your personal data in that policy.
The use of our Services is governed by the Mobile Network operators. As a consequence:
- Data collected from callers by us may be used by the Mobile Networks for regulatory purposes.
- The Mobile Networks may engage in random monitoring to check that the conditions of their code of practice are being compiled with. Where conversations are required to be recorded the Mobile Networks may call us for random samples of those transcripts for the same purpose.

8. Agreement Start

This agreement with you starts when you first register for the Services. These terms and conditions are the agreement. Once you have registered with LiveTarotText you will be considered “opted-in” to receive promotions about all the appropriate services that LiveTarotText offers. We may send you promotional messages as SMS or WAP push.

9. Using the Services

It is up to you to provide the equipment to connect to our Services, to pay any connection charges and to observe the terms, conditions and security procedures relating to those Services. Failure to do so may mean you are unable to access our Services.
Our Services may provide links to other Services which you may be linked to. We are unable to accept any responsibility for these other resources if you purchase anything from there in error. You will need to ensure that before using any Services, you read the terms and conditions and that you agree to the conditions prior to starting the Services.
LiveTarotText do not resell or pass on user data / details unless required to do so by law or an industry regulator.
In connection with our information we make all reasonable efforts to provide information that is accurate at the time of its inclusion. However, there may be errors, inaccuracies or omissions in respect of which we exclude all liability.
Your usage of our Services is entirely at your own risk. You should exercise a degree of caution in evaluating what you read when involved in communication with people who are unknown to you (such as when you are using the chat line Services) and be aware that people may not necessarily be who they say they are and that people may provide information or behave in a way that is unreliable or misleading. This caution is particularly relevant, but not limited to information on, names, places of work, address or telephone numbers or if you asked to arrange a meeting.
The Tarot service offers views and opinions for entertainment only, and are in no way to be relied upon as correct, factual or definitive in any manner whatsoever.

11. Providing Services

When providing the Services to you we promise to use the reasonable skill and care of a competent provider of Services.

- We take reasonable care to safeguard the security of any information you input or send to us in connection with the Services. We accept no responsibility for any damages that you may suffer as a result of the loss of the confidentiality of information input or sent to us in connection with our Services.
- We may need to temporarily suspend the Services due to maintenance work that is carried out. Such notice will be given and we will ensure that the Services are restored as quickly as possible.
- The Services use the networks of licensed telephone operators for the communication that enable the Services. We cannot guarantee that our Services will be uninterrupted or error free. Neither can we guarantee that the transmission of information over mobile networks will be secure.
- We will correct all reported faults as soon as we can. There may be unscheduled times therefore, when the Services becomes unavailable and at those times, it may not be possible to provide notice that the Services will be unavailable. We cannot guarantee the Services will be fault free.
- All users of the Services acknowledge that we cannot be responsible for the behavior or actions of other users at any time or place.

12. Suspension

We can suspend or restrict your access to our Services or terminate this Agreement (or both) immediately if:

- You breach this agreement and fail to remedy the breach within a reasonable period of being asked to do so;
- We believe that our Services is being used in a way forbidden by paragraphs 3, 5 or 10, even if you do not know that our Services is being used in such a way;
- We believe your use of our Services causes or is likely to cause the whole or part of our Services to be interrupted, damaged or in any way impaired;
- If we believe that your account is inactive;
- If we find out that there are bankruptcy or insolvency proceedings brought against you or an appointed administrator is appointed over your assets;
- Criminal proceedings are brought against you;
- If we do suspend your access to our Services, it will not be restored until you satisfy us that our Services will only be used in accordance with the Agreement;
- If your access to our Services is suspended because of a breach of this agreement by you, this Agreement will still continue.

13. Matters beyond our reasonable control

If we cannot fulfill this Agreement because of something beyond our control such theft, operator or contractor error, earthquakes, lightning, flood, terrorism, national or local emergency, or any industrial disputes of any kind, we will not be liable for this.

We have no control or responsibility for the truth or accuracy of any material available through our Services whether provided by users or not.

If any such events continue for more than 14 days you can terminate this Agreement provided that you give us notice.

If the events continue for more than three months, we can terminate this Agreement by giving you notice.

14. Changes

We may alter or amend at any time any aspect of our Services provided such alteration or amendment does not require any material change to this Agreement.

We reserve the right to change this Agreement from time to time and post the new version on our website.

The new terms and conditions will take into effect:

- Immediately if the changes do not adversely affect you or,
- After one month, the changes are capable of adversely affecting you and if you do not wish to be governed by the new Agreement, you may notify us before the date when the new version of the Agreement is to take effect and from that date, you must cease to use the LiveTarotText’s Services.

You will by this time have accepted any amendment to LiveTarotText’s Services or this Agreement if you continue to use LiveTarotText’s Services after the relevant period of notice has expired.

15. Liability

We have no liability to you or any other person for any losses or damages that you or anyone else may incur. This can be by way of another person using your mobile phone and using our Services without your permission.

We have no liability of any sorts for acts, omission or errors of providers of telecommunication Services or for faults in or failures of their networks and equipment.

16. Other matters

We may re-assign this agreement to any person taking over the supply of our Services or any part of our Services without your prior consent by giving you notice.

We may assign the provision of our Services or any part of our Services to any other person.

17. License to download

You acknowledge and agree that the content made available as part of the Services are owned by the company, its affiliate as applicable and are protected by the intellectual property laws. Company hereby grants and you hereby accept a limited, non exclusive, non transferable, revocable license to download and use the Downloads and the Services on a designated compatible mobile device solely for your own personal non-commercial use.

18. Notice

Any notice that either of us gives to the other under this Agreement must be done either in writing or by telephone herein.

In the case of notices sent by SMS such notices will be deemed to be received when accepted by your mobile phone network. In the case of notices sent by post such notices shall be deemed to be received on the second business day after posting. In the case of notices posted on the web sites, such notices will be deemed to be received when available to the public.

19. Intellectual Property Rights

Except as otherwise set forth herein, all right, title and interest in and to any intellectual property, proprietary rights or other rights related to intangible property which are used, developed, comprising, embodied in, or practiced in connection with any of the Services ("Company Intellectual Property Rights") are owned by Company or its licensors, and you agree to make no claim of interest in or ownership of any such Company Intellectual Property Rights. You acknowledge that no title to the Company Intellectual Property Rights is transferred to you, and that you do not obtain any rights, express or implied, in the Services, other than the rights expressly granted in this Agreement. Celebrity fun sounds are performed by impressionists. They do not carry the approval or endorsement of the celebrity involved or any broadcasting institution.

20. UK Law

The provision of our Services and the application of this agreement are governed by the English Law and the parties hereby agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or matter arising in connection with this Agreement.
